Terms of Service

1. Acceptance of Terms

By accessing or using the Make It Happen Leadership platform (“Platform”), operated by Make It Happen Lifestyle Leadership, LLC (“Company,” “we,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform following any changes constitutes acceptance of those changes.

2. Description of Service

Make It Happen Leadership is a leadership development platform that provides online courses, coaching tools, self-assessment exercises, an AI-powered coaching assistant, and community features designed to help individuals grow as leaders, negotiators, and professionals. The Platform is created by Robert “Bob” Kistner, drawing on over 40 years of leadership and sales experience in the hospitality industry.

3. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials and not share them with others
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account and use the Platform.

4. Membership, Courses, and Payments

The Platform is sold as two separate things: a membership, which opens the Platform itself, and courses, which are purchased individually and owned for life. A membership is not a license to the course library, and buying a course is not a membership.

• Free Trial: A time-limited trial offering course previews, sample materials, and community features.
• Membership (monthly or annual): A recurring subscription that provides access to the Platform — the AI coaching assistant, the community and live discussions, newsletters, the podcast archive, and the downloadable resource library — together with a 25% discount on the purchase price of any course. Membership does not by itself grant access to course content; courses are purchased separately at the discounted member price. Annual membership includes everything in a monthly membership, billed once a year at a lower total price.
• Individual Course: A one-time purchase granting lifetime access to that specific course, its workbook, and its community discussion room. If you are not a member at the time of purchase, your purchase also includes 6 weeks of full Platform access so that you can work through the material. Courses you have purchased remain yours after that period ends, and after any membership ends.

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Courses are billed once, at the time of purchase. All payments are processed securely through our third-party payment processor. Prices are listed in US dollars and are subject to change with 30 days written notice; a change in course pricing does not affect a course you have already purchased.

Some courses are listed as forthcoming. A course is charged for, and becomes accessible, only once it is released — neither a membership nor a course purchase is a commitment by us to publish any specific future course on any particular date.

5. Cancellation and Refunds

You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain Platform access until that date. We do not offer prorated refunds for partial billing periods.

Cancelling a membership does not revoke any course you have purchased; those remain accessible to you for life. For individual course purchases, we offer a 14-day refund policy from the date of purchase, provided you have not completed more than 25% of the course content.

6. Intellectual Property and Content Rights

All content on the Platform, including but not limited to courses, videos, text, graphics, frameworks, assessment tools, and the AI coaching assistant, is the intellectual property of Make It Happen Lifestyle Leadership, LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial development purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without our prior written consent.

7. AI Coaching Disclaimer

The AI coaching assistant provides guidance based on Bob Kistner’s leadership philosophy and general best practices. It is not a substitute for professional advice, therapy, legal counsel, or certified executive coaching. The AI may occasionally produce inaccurate or incomplete responses. You acknowledge that you use the AI coaching feature at your own discretion and risk.

8. User Conduct

When using the Platform, you agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Share, resell, or redistribute course content or account access
• Harass, intimidate, or abuse other users in community features
• Attempt to reverse-engineer, decompile, or extract the source code of the Platform or AI system
• Upload or transmit viruses, malware, or any harmful code
• Scrape, crawl, or otherwise automatically collect data from the Platform

9. Limitation of Liability

To the maximum extent permitted by law, Make It Happen Lifestyle Leadership, LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Austin, Texas.
